Several applications carried over at zoning meeting

(by Sam Passow - August 13, 2008)

Several items from the Aug. 6 board of adjustment meeting were carried to the Sept. 3 meeting.

New Cingular Wireless had an application placed on the July meeting agenda after a state appeals court judge reversed the board’s denial of its original application to install cellular telephone antennas on top of a self-storage building at 410 River Road. The board will decide any "reasonable" conditions that it wants to impose, such as the color or type of screening in front of the antennas.

The application was carried to the Aug. 6 meeting, but the attorney for New Cingular Wireless had a scheduling conflict and asked to carry the application to the Sept. 3 meeting.

An application from Marco Benhaim to expand an existing improvement, without increasing the total number of units, at 511 Undercliff Ave. was also carried. Acting Chairman Robert Corcoran said that the public notice for the application was incorrectly printed in the newspaper so it would have to wait to be heard.

An application by Omnipoint Communications, also known as T-Mobile, was carried over at request of the applicant. Corcoran said the company wanted to wait because of an upcoming change in the borough’s cellular phone ordinance. When the court overruled the board’s denial of New Cingular Wireless’ application, it recommended that the borough modify its cellular antenna ordinance.

Borough Administrator Greg Franz said the council was expected to introduce an amendment to the ordinance at the Aug. 11 mayor and council meeting.

"I heard from John Candelmo [the borough’s on construction code officer] that there are other applications on hold so that the companies can make sure they conform to the new code," Franz said.

An application to convert a house at 26 Lasher Lane into a three-family residence .was also carried. The application requires five affirmative votes from the nine-member board. There were only five members present at the meeting, which Corcoran said unfortunately happens at meetings in the summer because of members’ vacation schedules.

The Sept. 3 meeting will be at 7 p.m. in the council chambers in borough hall.
